OWASA: Sewage sludge safety risks 'negligible'

After our recent stories on sewage sludge, the Orange Water and Sewer Authority sent a letter to local governments about their biosolids program.

HOW MUCH: OWASA treats about 8.5 million gallons of sewage and generates about four dry tons of sludge per day. OWASA’s biosolids are produced according to federal and state requirements that allow their reuse as a fertilizer, according to the letter, which was sent to Carrboro Mayor Mark Chilton, Chapel Hill Mayor Kevin Foy and Valerie Foushee, chairwoman of the Orange County Board of Commissioners.


WHERE IT GOES: OWASA has liquid land application permits for a total of 1,156 acres of farm land in Orange, Chatham and Alamance counties. Nearly 90 percent (1,013 acres) is privately owned. The remaining 143 acres are owned by OWASA as part of a 700-acre tract west of Orange Grove Road in Orange County.  The maximum amount of biosolids that can be applied to a given field is determined by the nitrogen content of the biosolids and is limited to the nitrogen requirements of the particular crop to which it is being applied. OWASA closely monitors the application rates on each individual field and, historically, has applied at rates well below those allowed by regulation.

TESTING: OWASA'S biosolids are tested for toxicity and certain other characteristics once a year; but trace metals, solids, and nutrients are measured every 60 days. OWASA monitors three times a year for groundwater contamination and measures multiple constituents in plant tissues once a year at OWASA-owned locations that receive biosolids.

The letter cites a 1996 National Academy of Sciences/National Research Council review of EPA’s biosolids management program that found biosolids presents “negligible risk” when conducted according to federal regulations.

OWASA'S CONCLUSION: “OWASA recognizes that some uncertainty still exists about the effects of certain biosolids constituents. We support further study to determine these impacts. However, OWASA also firmly believes that recycling biosolids through a properly managed program in strict compliance with State and Federal permit requirements is a safe, cost effective, and environmentally responsible way of managing this inevitable by-product of the community.”

Disappointed in the editors of the N&O

This thread has been hijacked by some anonymous person criticizing an individual who has not posted on this story, and who was not mentioned by the story itself. He is using this forum to slander someone that he disagrees with, and the editors are letting it happen. If his was a letter to the editor, it would not have been published.

If the editors at the N&O want to know why this blog has no credibility, you need look no further than this thread. This isn't a failure of the media, it's a failure of the individuals who manage the media.

The Synagro permit has been

The Synagro permit has been held open for public comment due to the efforts of Nancy Holt. She even appealed to John Edwards (champion of the poor and oppressed) back in 2004 to hold up the issuance of the permit but since the City of Burlington has been in compliance, they have continued to apply material under their old permit.(which is lawful)

Plainly put tblake, you do not seem to understand the permitting process for if you did you would know, and state, the set back distances from wells, property lines, homes, the slope restrictions etc. You would also know about the public comment period as well as the efforts by certain groups to hold up permits. You can contact utilities officials at either Burlington or OWSAS and I am certain they will provide you as much information as you request. You can take the bull by the horns here my friend. It is public record if you can digest the facts.

So their permit has not expired. It has been held open by political pressure despite their compliance with the law.

Burlington and OWSAS follow the law, period. The reporting and compliance requirements as well as the soil morphology testing in addition to the mapping, soil sampling and so forth make this a very lengthy process and highly regulated.

I have nothing personal against Nancy Holt. I've meet with her several times and each time she was presented the scientific facts she sought to introduce emotion and sensationalism to the issue solely because her morning tea was disrupted by trucks leaving and entering the property next to hers. I know this because Nancy told me that was what "really pissed her off". I was there when the Orange County Board of health told her there was no problem, I was there when the well testing results came back, I gave her contact information, I gave her permits........and so on and so on............I know the issue and I know the nutball people of Orange County.

The truth is not the issue here nor is the supposed "environment". The issue is a bunch of bullies with no concept of what they are speaking about so they speak in collectivist terms like "our food", "our streams" and "our children".

Basic science

changes and expands as we learn. It is not fixed and static as you are trying to make it out to be. At one time, no one thought asbestos was a problem. But it was and we're still trying to clear it up. Scientists are open to new ideas and learning; bureaucrats do their best to protect the status quo.

Testing is only useful if you know what you are testing for. The recent science has said that there are more toxins in sludge than current tests can measure. For example, the USGS has found that even small quantities of estrogen in streams are having an effect on fish and amphibians. Where do those estrogens come from? Wastewater definitely, and presumably from sludge as well. The US Geological Service has done some excellent and very credible field studies if you are interested.

As for Nancy, she is emotional about this issue. She's an activist; she's bucking up against a system and the bureaucrats within the system. It's your right to disagree with her, but I think it's in incredibly bad taste for you to turn a discussion on sludge into a rant on Nancy.

The increase in deer is due to the huge number of deer huggers in this area.  I keep hoping some disease will finally reduce their numbers.  Come on, mother nature, overrule the deer huggers once and for all, please.

What good is a permit

if it is lawful to keep going for 5 years after it expires? Do you drive after your driving permit has expired? What good is a permit that can be held up for 5 years for comments?

The point you don't seem to understand is that  the permit is meaningless bureaucracy and has no bearing on the safety of the application or the enforcement of the rules.

I'll say it again; Toxins that have been shown to exist in this sludge are not regulated and the "testing" of the sludge is left up to the very agents that have a financial motive to keep dumping it. It has been alleged and documentd that Synagro breaks the rules and no one from federal state or county is monitoring their activities. Studies have been commissioned and never released.  If the permit has been held up for 5 years one might conclude that there might be a reason or that the permit is just a piece of paper, capice?

My opinion is that the the history of corporate behavior in this country and potential for negative externalities make a convincing case that the burden of proof of safety is on the agency and corporate entities that are dumping this crap. If the case is that this activity is harmless and they are following the rules, then Synagrow and Owasa need to go to extraordinary lengths to prove it. Furthermore, some agency state or federal needs to effectively license and monitor the process then publish the results.

You can spout "science" and "truth" all you like, but if the "science" is not applied and the "truth" not enforced by an impartial third party it's more meaningless drivel.

Your opinion, frustration toward this Nancy Holt person is obvious to even a casual observer and it apparently undermines your objectivity.

I doubt any of you have a general grasp of science much less the ability to read or understand a permit.

The o200 rules regulate the states and the county application of material. The 503 regulations are the federal rules governing the application of Class B and Class A biosolids.
The City of Burlington has consistently come out smelling like roses in every review performed by DENR. All of their testing is public record and their permit is public record.

The requirements under the law for any industry or municipal body is provided for by the governing laws I pointed out above which are codified specifically in their respective permits.

What this world does not need are local uneducated activists telling people what they can do with their private property. The damning "evidence" supplied by the responders to this article is a knee slapper of grand proportions.

I hold degrees in agronomy and soil chemistry from NCSU so I'll be back to kick the hell out of any more non-sense you folks throw out.

I do not work for Synagro, the City of Burlington or OWASA but I know about a certain crazy lady named Holt and I know about her efforts to discredit anyone that stands in her way.
She loses every fight she enters but nothing deters her from her cause.

And Nancy, if you are reading this, I drank your well water back in 2003 and I supplied you with permits, information and all sorts of other stuff. I was always nice to you and you were always mean as hell.

This is Orange County we are talking about.  The facts don't matter.  Quit with the facts already, they can't feel good about this protest if you provide facts.  Plus some of the posters are OWASA apologists, they cannot have this sort of factual data disturbing their latest cause.

ban out-of-county sludge

Burlington contracts with Synagro to dump their sludge & some of land they use is in Orange County, even in the Cane Creek reservoir watershed. OWASA does not contract out any of the sludge hauling & application process, so they have much more control.

We should ban out-of-county sludge. There's no telling what Synagro could get away with if they wanted to.

sorry i am so late to this party... but...in response to any 'glowing praise' for OWASA on this thread... they sludge 167% MORE per acre THAN SYNAGRO...  OWASA throws down three times more sludge on the same number of acres as SYNAGRO does....  if you want to see the math... leave me a message on here... ill be glad to show the FACTS.... AND OWASA sludges in counties other than the OC....

Just ban pooping.  Problem solved.  Orange Progressives will be on board with this ban shortly.  Since it is a ban.

I was sorry to hear the defensiveness in the tone of this letter. OWASA abides by the law and goes beyond what the law requires. They are to be commended for that.

 The challenges most of us who have concerns about the land application of sludge is with the law, not OWASA's adherence to the law.

The 1996 EPA regulations do not represent the science that has evolved over the past several years. We now know that phthalates, pharmaceuticals, PBDEs, and many other chemical structures found in sludge are just as destructive to the environment as the heavy metals and nitrogen that the 1996 law addressed and that current NC law regulates in accordance with that law. 

We're at a juncture where we can choose to recognize a problem before the regulations change, or we can continue to deny the problem. 

I'd like to see OWASA join with local authorities and activists to:

1. Encourage the NC legislature to give our local authorities to regulate land applications here in Orange County;

2. Begin a systematic search for safe, feasible alternatives to land application; and

3. Self-regulate their practices by extending setbacks from residences and waterways beyond what is required by law, and by providing advance notice to residents living in the vicinity of land where sludge is being applied.

Will OWASA take that proactive challenge or continue to deny what is right in front of their eyes? Sludge, whether it's class A or class B (like what Alamance County is spreading over large areas within Orange County), poses a long-term threat to our water, our food crops, and our wildlife. This is the time for OWASA to partner with local environmental activists and demonstrate, once again, their commitment to the health and welfare of the county.

I would add that even the laws in place right now are not enforced. There is no permitting and no monitoring at the federal, state or county level. Thus companies have nothing to lose by breaking the rules.

To be accurate

There is permitting at the state level and the county tries very hard to monitor. Orange County has stricter notification requirements than anywhere else in the state. But enforcing those requirements is a challenge. OWASA complies, but Burlington doesn't always.

 Sludge is sludge Mark, whether it comes from Synagro or OWASA. OWASA does mitigate some of the challenges of sludge by applying it at ground level rather than spraying it into the air where it can fly all over neighboring properties. However, they still don't use deeper setbacks from property lines and waterways as has been proposed for making a bad practice (land application) a bit less damaging.
