BioDelivery Sciences today announced more good news in its ongoing patent battle involving Onsolis, its oral pain patch for cancer patients.
Raleigh-based BioDelivery reported that the U.S. Patent and Trademark Office has rejected all claims by MonoSol RX regarding one of its patents. The latest ruling, which comes in the wake of a November ruling that went in BioDelivery's favor, means that the patent office has rejected all claims involving two of the three patents that MonoSol alleges are being infringed by BioDelivery.
A ruling on the claims involving the third patent is expected shortly, BioDelivery said.
MonoSol sued BioDelivery for patent infringement in federal court in New Jersey in November 2010, seeking unspecified damages and an injunction barring future infringement of MonoSol patents. BioDelivery maintains that it is not infringing on MonoSol's patents.
Onsolis has been available in the United States since October 2009.
